Calon hakim agung Muhammad Daming Sanusi menyatakan, hukuman mati tidak layak diberlakukan bagi pelaku pemerkosaan. Penjelasannya soal ini mengundang tawa sejumlah anggota Komisi III saat berlangsung fit and proper test hakim agung di Komisi III DPR pada Senin (14/1/2013) ini.
"Bagaimana menurut Anda, apabila kasus perkosaan ini dibuat menjadi hukuman mati?" tanya anggota Komisi III dari Fraksi PAN, Andi Azhar, ketika itu kepada Daming.
Daming menjawab, "Yang diperkosa dengan yang memerkosa ini sama-sama menikmati. Jadi, harus pikir-pikir terhadap hukuman mati."
Jawaban Daming ini pun langsung mengundang tawa, tetapi tidak sedikit yang mencibir pernyataannya. Dijumpai seusai menjalani fit and proper test, Daming berdalih bahwa pernyataannya itu hanya untuk mencairkan suasana.
"Kita tadi terlalu tegang, jadi supaya tidak terlalu tegang," imbuhnya.
Menurut Daming, hukuman mati harus dipertimbangkan baik-baik. Ia beralasan, dirinya belum memberikan jawaban tegas apakah ia mendukung atau tidak penerapan hukuman mati bagi pelaku pemerkosaan. "Tentu kita harus pertimbangkan baik-baik kasus tertentu, seperti narkoba, korupsi, saya setuju. Tapi untuk kasus pemerkosan, harus dipertimbangkan dulu. Tadi saya belum memberikan jawaban yang tegas," kata Daming.
Menanggapi pernyataan itu, anggota Komisi III lain dari Fraksi Partai Demokrat, Himmatul Aliya Setiawati, menilai candaan Daming sangat tidak pantas.
"Saya kira candaannya tidak pas. Saya setuju ada hukuman mati ya," ucap Aliya.
Meski menganggap tak pantas, ia menilai jawaban Daming sudah memenuhi kriteria yang diharapkan dari seorang hakim agung. "Dari Fraksi Gerindra menyatakan tidak akan memilih, tapi kalau saya sih soal memilih kita lihat nilai-nilai keseluruhannya," tutur Aliya. (Sumber: kompas.com
